Stefan Borson: How Burnley vs Everton could impact Leeds United's legal battle

Published on

Leeds United's legal battle against Leicester City could be impacted by the result of Everton's appeal against Burnley.

That is according to former Manchester City financial adviser Stefan Borson, who exclusively told Football Insider that Leeds could change their course of action should the Toffees win their appeal.

The Merseyside outfit are being ordered to pay £40million in compensation after it was claimed that the club's PSR breach helped Everton to avoid relegation in 2023, with the Clarets going down instead.

Unsurprisingly, David Moyes' side lodged an appeal, and the outcome could set a precedent for any future legal battles in the Premier League.

It is uncertain exactly what type of legal battle the Whites are pursuing after Leicester broke financial rules in their promotion-winning season back to the top flight.

This meant that Daniel Farke's side were bumped down into the play-offs, and eventually failed to secure promotion out of the Championship.

Leeds United's case against Leicester City could be 'stymied'

It is an extremely difficult situation already, especially for confused supporters, and previous legal cases could seemingly play a role.

Speaking exclusively to Football Insider, Borson said: "If Everton win the appeal against Burnley around when a breach of PSR kicks in, if that turns out to be 30 June, it might actually stymie Leeds' case.

"I think it's unlikely. And so, let's say it proceeds. If the case proceeds, I think Leeds will have to run the case differently from Burnley.

"Burnley went for an all-or-nothing on a balance of probabilities that Everson would have got four or more points fewer. The problem that Leeds have got is Leicester were seven points ahead of them.

"So they've got to say that Leicester's overspend, which was significant in the context of the EFL, and they overspent by about 25%, was enough to stop them.

"So Leicester's cap was £83m. The overspend was about £20m-£25m, a significant overspend, but is it significant enough to say, had they not overspent, they would have been left with seven points less?

"I think that's a difficult case to win for Leeds."

How have Leicester fans reacted to the news?

There has certainly been a mix of reactions. While some fans have taken a humorous route, others have been left very frustrated and upset by the news.

It also raises questions about potential future lawsuits against Chelsea and Man City, who are both under the cosh when it comes to finances.

As long as the Citizens have the 115 charges hanging over their heads, rival fans are unlikely to take any other punishments seriously.
