Exclusive: Everton can now land two-point deduction in new twist – Wyness

Former Everton chief Keith Wyness believes Everton can reduce their second points deduction down to just two points by arguing double jeopardy.

Speaking on the new edition of Football Insider’s Inside Track podcast, the 66-year-old – who served as CEO at Goodison Park between 2004 and 2009 and now runs a football consultancy advising elite clubs – explained that the Toffees have already been punished for two of their last three financial accounts.

Everton successfully appealed their 10-point deduction last week with an independent commission reducing the punishment down to six points after admitting that “legal errors” had been made.

The Merseyside club will now begin their second hearing after they were charged with exceeding allowable losses of £105million again following the release of their 2022-23 accounts.

As revealed by Football Insider, Everton are expecting a further six-point deduction from their second hearing taking the total punishment to 12 points.

Regulations state that top-flight clubs can not exceed £105million in losses over a three-year period.

Therefore, Everton’s 2020-21 and 2021-22 accounts have already been assessed and punished within their first charge.

Wyness believes the Toffees will argue double jeopardy to reduce the potential points deduction down to a third in size.

Without doubt, I think it is fair for Everton to argue double jeopardy in their second case,” Wyness told Football Insider.

If two of the years that this particular panel is going to be looking at have already been sanctioned, then I think a very fair legal precedent on double jeopardy is well established.

So I think Everton will look to reduce a second penalty down to around a third in size.

So if it was going to be six points again, it may only be two.

Again, if they look at the mitigating circumstances in a more favourable light, which I think is very, very clear, I think it should be looked at again.
