Everton points deduction appeal plan is revealed – sources
Everton will plead that they have been penalised twice for the same offence in the same season in their points deduction appeal, sources have told Football Insider.
Speaking on the latest edition of Football Insider’s Inside Track podcast, transfer correspondent Pete O’Rourke revealed that the Toffees will use the double jeopardy argument in their attempts to reduce or remove their latest sanction.
Sean Dyche’s side were hit with a two-point deduction on Monday (8 April) after they breached the allowed loss threshold of £105million by £16.6million in the three-year period up until the 2022-23 season.
However, their 10-point deduction from November, which was reduced to six in February after an appeal, accounted for a breach in their finances in the three years to the 2021-22 season.
Everton set to use double jeopardy argument in deduction appeal
It is believed that Everton will argue that they have already been punished for irregularities relating to their 2020-21 and 2021-22 accounts, which the club see as “unfair”.
A verdict for Everton’s latest appeal to an independent commission must be reached and revealed by 25 May.
Their recent accounts published on 31 March revealed a statutory loss of £89.1million for the 2022-23 season, meaning they could have a third charge on the horizon unless they can sanction significant player sales this summer.
The total eight-point deduction this season has put the club’s Premier League status under threat as they now sit just two points ahead of 18th-place Luton Town.
They still have to face title-chasing Liverpool and Arsenal before the end of the season as well as the relegation-battling Hatters, Nottingham Forest and Sheffield United.

Everton now sit 16th in the Premier League table after their latest deduction and following their 1-0 win against Burnley on Saturday (6 April).
They are next in action against Chelsea at Stamford Bridge on Monday night (15 April).
